Article 1: General terms & conditions

The seller’s e-commerce webshop offers its customers the opportunity to purchase the products from its webshop online. These General Terms and Conditions (“Terms and Conditions”) apply to any order placed by a visitor to this e-commerce webshop (“Customer”). Additional conditions of the Customer are excluded, except when previously, in writing and expressly accepted.

Article 2: Price

All prices stated are expressed in euros and, unless otherwise stated, include VAT. If delivery, reservation or administrative costs are charged, this will be stated separately.

The stated price refers exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes and may contain elements not included in the price.

Article 3: Offers and quotes

Despite the fact that the online catalogue and the e-commerce webshop are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up-to-date. Obvious mistakes or errors in the offer are not binding. Under no circumstances shall the Vendor be liable in the event of manifest material errors, misprints or printing errors. If the Customer has specific questions about e.g. sizes, colour, availability, delivery period or delivery method, we request the Customer to contact our customer service department in advance.

The offer is always valid while stocks last and may be amended or withdrawn at any time. The seller cannot be held liable for the unavailability of a product.

Article 4: Online purchases

The Customer has the choice between bank transfer or credit card as methods of payment.

The Vendor is entitled to refuse an order following a serious fault on the part of the Customer with regard to orders involving the Customer.

Article 5: Delivery and performance of the contract

Any visible damage and/or qualitative deficiency of an article or other shortcoming in delivery must be reported by the Customer without delay.

The risk due to loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods.

Orders are always processed within 5 working days (working days are Monday – Friday) unless otherwise indicated in the shipping method or due to closure by holidays or holiday period. Closure for holidays is always clarified on the webshop. Standard delivery time is maximum 30 days, but in exceptional cases the delivery time may increase. An exceptional situation may be that products are not in stock. If the delivery period exceeds 30 days because of this reason, the customer will be informed. If any other reason should arise that affects the delivery period and makes it longer than 30 days, the customer will be informed directly.

Article 6: Retention of title

The delivered articles remain the exclusive property of the Vendor until complete payment by the Customer.

Article 7: Right of withdrawal

The provisions of this article apply only to Customers who purchase articles online in their capacity as consumers.

Consumers have the right to withdraw from the contract without giving reasons within a period of 14 calendar days, unless otherwise stipulated, given that the right of withdrawal applies to the good or service ordered by the Customer. In order to exercise the right of withdrawal, the Customer, must inform the seller of its decision to withdraw from the contract in due time by an unequivocal statement (e.g. in writing by post or e-mail). The Customer must return or hand over the goods immediately after its decision to withdraw from the contract. The direct costs of returning the goods shall be borne by the Customer unless otherwise agreed.

If the returned product is somehow reduced in value, the right is reserved to hold the Customer liable and claim compensation for any reduction in value. Only items in their original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.

In case the contract includes the provision of services and if the Customer has requested for the provision of services to begin during the withdrawal period, the Customer shall pay an amount proportionate to what has already been delivered at the time he notified us that he is withdrawing from the contract, compared to the full performance of the contract.”

Article 8: Guarantee

Under the Act of 21 September 2004 on consumer protection in the sale of consumer goods, consumers have legal rights. This legal guarantee applies from the date of delivery to the first owner. To invoke the warranty, the Customer must be able to present proof of purchase.

The (commercial and/or legal) warranty never applies to defects caused by accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, modifications or alterations to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Article 9: Penalties for non-payment

Without prejudice to the exercise of other rights, in the event of non-payment or late payment, the Customer shall be liable, ipso jure and without notice, to pay interest on the unpaid amount from the date of default. Without prejudice to the foregoing, the right is reserved to take back items that have not been paid for (in full).

Article 10: Invalidity – non-enforcement

If any provision of these Conditions is declared invalid, illegal or null and void, this shall in no way affect the validity, legality and applicability of the other provisions.

The seller’s failure at any time to enforce any of the rights enumerated in these Conditions, or to exercise any right thereof, shall never be considered a waiver of such provision and shall never affect the validity of such rights.

Article 11: Modification of conditions

These Conditions are supplemented by other conditions explicitly referred to and the seller’s general terms and conditions of sale. In case of contradiction, these Conditions shall prevail.

Article 12: Applicable law

Belgian law shall apply. The courts of the Seller’s domicile have jurisdiction in the event of legal disputes. The Seller may also turn to the ODR platform.
